Terms of Service

These terms form the agreement between you and us when you use the IP Address Today website or API. By creating an account or calling the API, you accept them.

In these terms, “we”, “us”, and “our” mean the entity above; “you” means the person or organisation using the service.

The service

We provide an IP geolocation API and website that return information associated with an IP address, including approximate location, network operator, and timezone. Plan entitlements — request quotas, key limits, and features — are those described on our pricing page at the time you subscribe.

Geolocation is inherently approximate. We describe accuracy honestly (every response includes an accuracy radius), but we do not warrant that any particular result is correct. See “Accuracy and fitness” below.

Accounts

  • You must provide a valid email address and keep it current — we use it for security and service notices.
  • You are responsible for activity under your account and for keeping your password and API keys secret.
  • API keys are shown once. If a key is exposed, revoke it in the dashboard immediately.
  • You must be at least 16 years old to create an account.
  • Tell us promptly at [email protected] if you suspect unauthorised access.

Acceptable use

Your use must comply with our Acceptable Use Policy, which forms part of these terms. In short: do not use the service to break the law, to harm or track individuals, to resell our raw data as a competing database, or to evade quotas and rate limits.

Fees, GST, and billing

  • Paid plans are billed in advance through Stripe on the cadence you choose — monthly, or annually at a discount — and renew automatically until cancelled.
  • Prices shown are in US dollars and exclude tax. We are registered for GST in Australia, so 10% GST is added to purchases by customers in Australia, and a tax invoice showing our ABN is issued for each payment.
  • If payment fails we may retry, and may suspend or downgrade your plan if it remains unpaid.
  • We may change prices with at least 30 days' notice by email. Price changes never apply to a period you have already paid for.

Cancellation and refunds

You can cancel at any time from the billing page. See our Refund and Cancellation Policy for the details, including your rights under the Australian Consumer Law, which we cannot exclude.

Quotas, rate limits, and suspension

Requests beyond your plan's quota or rate limit are refused with an HTTP 429 response — we will never silently bill you for overage. We may suspend or terminate an account that breaches these terms, places the service at risk, or remains unpaid. Where practical we will warn you first; for serious breaches or active abuse we may act immediately.

Availability

We aim to keep the service available continuously and publish its status, but we do not currently offer a contractual uptime guarantee on any plan. Maintenance, upgrades, provider outages, and events outside our control can interrupt service.

Accuracy and fitness for purpose

IP geolocation identifies where a network is registered or routed, not where a person is. It is unsuitable on its own for emergency response, legal identification, or any decision with significant consequences for an individual. You are responsible for deciding whether the data is appropriate for your use, and for complying with privacy law when you process the results.

Geolocation data is derived from MaxMind's GeoLite2 databases and is subject to their accuracy and update cycle.

Intellectual property

We retain all rights in the service, the website, and our software. You retain all rights in your own applications and data. Subject to these terms, we grant you a non-exclusive, non-transferable right to use the API and its responses within your own products and services for the duration of your subscription.

The service includes GeoLite2 data created by MaxMind, available from maxmind.com.

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited at our option to resupplying the service or paying the cost of having it resupplied.

Warranties and liability

Except as set out above and to the maximum extent permitted by law, the service is provided “as is”, and we exclude all implied warranties. We are not liable for indirect, incidental, or consequential loss, or for loss of profits, revenue, goodwill, or data.

To the maximum extent permitted by law, our total liability arising out of or in connection with the service in any 12-month period is limited to the total fees you paid us in that period, or AUD 100 if you are on a free plan.

Indemnity

You indemnify us against claims, losses, and costs arising from your use of the service in breach of these terms or in breach of law, including claims brought by individuals whose data you processed using our results.

Termination

You may stop using the service and delete your account at any time. Either party may end this agreement for material breach that is not remedied within 14 days of notice. On termination your access ends, and we handle your data as described in the Privacy Policy.

Changes to these terms

We may update these terms as the service develops. Material changes will be notified by email or in the dashboard at least 14 days before they take effect, and continuing to use the service after that means you accept them. If you do not accept a change, cancel before it takes effect.

Language

These terms, and our other policies, are written and published in English. Parts of our website are available in other languages for convenience; if we ever publish a translation of these terms and it differs from the English text, the English version governs.

If you are a consumer in a country whose law gives you rights that cannot be excluded by agreement — including the right to be addressed in your own language — nothing here limits those rights.

Governing law

These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state and the courts able to hear appeals from them.

If you deal with us as a consumer outside Australia, the mandatory consumer-protection law of your country of residence may also apply. That law prevails over this clause to the extent the two conflict.
